Commissionaportrait - Terms and Conditions
The terms and conditions which will apply to any work you commission from an artist through Commissionaportrait.com will depend upon a number of factors, including the type of work commissioned and the artist involved. The artist or Commissionaportrait.com may require you and any sitter to sign a short contract setting out the terms and conditions agreed in your particular case.
In the absence of any agreement to the contrary, however, the following terms and conditions will apply:-

Copyright in the commissioned work will remain with the artist. Commissionaportrait.com will be entitled to copy or reproduce the commissioned work in whatever manner it wishes for the purposes of publicity and promotion for itself and/or the artist.

The price payable for the commissioned work will be subject to any applicable vat and will be payable in instalments during the course of the work in accordance with the artist’s normal procedure. The artist will be entitled to charge interest at a reasonable rate on overdue payments.
All payments due to the artist will be required to be paid to Commissionaportrait.com which will be entitled to deduct its commission plus vat when accounting to the artist for the payment.

Any sitter will be required to give such sittings and other assistance, for example, photographs, as the artist requires for the successful completion of the work.

If you or any sitter cancels the commissioned work before it is completed, you will be required to pay such sum (taking into account payments already made) as will reward the artist for the work completed to the date of cancellation and all expenses incurred by the artist in connection with the commissioned work. The unfinished work will belong to the artist.

Any dispute arising in connection with the commissioned work between the artist and you and/or any sitter which cannot be resolved through Commissionaportrait.com shall be referred by Commissionaportrait.com to an independent arbitrator. His/Her decision shall be final and binding.

The contract for the commissioned work shall be governed by English Law.
